So how do you come to Australia now?
Well, the most suitable visa for you would be the Prospective Marriage Visa. The official title is “Prospective Marriage visa (subclass 300)”.
This Visa will allow you to come to Australia for nine months so that you can get married to your Australian fiancé.
Before you start the process of applying for you visa, there are some things that you must be aware of and they are as follows:
- You must be sponsored by an Australian
- You must be over 18 years of age
- You must have both met as adults with your Australian fiancé
- You must be able to get married under the Australian law and your home country’s law
- You must genuinely intend to marry and live together with you partner in Australia
- You must meet criteria for health and character
In this application you will have to prove to the Australian government that you are in a genuine and ongoing relationship.
You will be required to submit evidence like:
- Mutual photographs
- Declarations from yourself and your partner
- Declarations from other people who know you both
- A signed Notice of Intention to Marry as proof that you have organized your celebrant marriage in Australia
- Personal documents and more…
Ones you are granted this visa will have nine months to come into Australia and get married with your Australian partner. When you are married you may then lodge your Partner visa. You will then receive a bridging visa which will allow you to stay in Australia until your visa is decided. If in the nine months you do not get married to your Australian partner, then it will be extremely difficult for you to apply for any other visas while you are still in Australia.
There is one more thing though that you must know and that is that you and your Australian partner must be the opposite sex… If you are both of the same sex then you should consider applying for the de facto spouse visa. The main criteria for this de facto application is that you have been living together and been in a relationship together for over one year.
