Skilled Visas (Subclass 189, 186, 187, 190 & 489)

Skilled Independent Visa (subclass 189)

This visa is for the skilled workers, there is no need to receive a sponsor by a State or Territory or via a relative.
Applicants require the following:

  • Lodge an Expression of Interest (EOI)
  • Receive an Invitation to Apply
  • 45 years or younger at time of application
  • Competent in English
  • Points test must be 65 or higher
  • Choose an occupation on the Skilled Occupation List (SOL)
  • Ensure your skills and qualifications are up-to-date
  • Meet all health requirements
  • Meet all character requirements

Processing of your Visa
There are 3 basic stages;
Stage 1
A skills assessment is required.
This will ascertain if you have the required skills and attributes relating to your chosen position.
Stage 2
If you have received a positive testing on your skills assessment, you need to complete an EOI on Skill Select.
Stage 3
You will be issued now with an intention to apply (ITA).
Your final application will now be in the hands of the Department of Immigration.

  • Apply for Australian citizenship
  • Sponsor family for permanent residency
  • Medicare allowances
  • Security payments and allowances

Visas via Employer Nomination Scheme (subclass 186)

Firstly you must be nominated for this visa by an Employer.
Secondly the applicant must apply for this visa.
1)    The Employer

  • Be registered to run a legal business in Australia
  • Must comply with Australian Immigration Laws
  • Must comply with Australian Workplace Laws
  • Have a position available which is listed on the Employer Nomination List
  • Have a real need for a skilled worker
  • Have a full-time position available
  • Base salary payments as per listed by the Government
  • Must comply with Australian working standards

2)    The Applicant

  • May apply online via SkillSelect –via an Expression of Interest (EOI) (this is optional)
  • Must be nominated by an employer
  • Fulfill all skills and qualifications
  • You must hold all necessary licenses or registration documents obtained in your field of work (ie. Registered Doctor)
  • English language requirements to be met
  • Be 45 years or under
  • Certain exemptions may apply relating to age, skills and experience

Requirements for an Employer Nomination Scheme Visa
This visa is for permanent Employer Sponsors.
Skilled Workers must be chosen by Australian employers.
Some positions which are listed:

  • Professionals
  • Trade workers
  • Managers
  • Administrators
  • All positions must be listed on the Employer Nomination List

Regional Sponsored Migration Scheme (subclass 187)

This visa is for skilled workers who would like to live and work in Regional Australia.
These employment positions are created by Employers who are unable to fulfil the positions locally.
These visas are not granted for major cities such as Sydney, Brisbane, Perth etc…
Application Process

  • The employer must certify a full-time position is genuinely available
  • Wages are under Australian legal standards
  • Position is available for at least 2 years
  • The employer is unable to fill the position by locals
  • An employment contract will be written
  • Nomination needs to ensure all requirements are met and is certified by the relevant department

Requirements for a Visa Nominee

  • You have the option to also complete an EOI via SkillSelect
  • You must be nominated by an approved Australian company
  • This business must be in Regional Australia
  • Meet all skills and requirements as per specified
  • Must be 45 years or younger
  • Fluent in English as per required
  • Certain exemptions may apply relating to age, skills and experience

There are 3 Streams to this Visa
1)    Temporary Residence Transition Stream
This is under subclass visa 457, if you are already working in the position for 2 years, and your employer would like to offer you a permanent position
2)    Direct Entry Stream
This is if you have never or only worked for a short period of time in Australia
3)    The Agreement Stream
This is if you have been nominated by an employer via a labour or regional agreement

Skilled Nominated Visa (subclass 190)

A skills assessment is required and you need to forward an application online via SkillSelect, EOI.
You need to be chosen by a State or Territory and fulfill all requirements.
There are 3 basic stages;
Stage 1
A skills assessment is required.
This will ascertain if you have the required skills and attributes relating to your chosen position.
Stage 2
If you have received a positive testing on your skills assessment, you need to complete an EOI on SkillSelect.
A state or territory sponsorship now needs to be applied for.
Experience and qualifications is a must, when choosing from their listing on the State Migration Plan.
Stage 3
You will be issued now with an intention to apply (ITA).
Your final application will now be in the hands of the Department of Immigration.
